§ 1 Scope of Application

These Terms and Conditions (hereinafter referred to as "Terms") apply to the use of the platform "DeepedIn" (hereinafter referred to as "Platform"), which is accessible at the domain deepedin.com.

The operator of the platform is Franz Miratsch, Vienna, Austria (hereinafter referred to as "Operator").

All legal relationships between the Operator and users are exclusively governed by Austrian law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG) and conflict of law provisions.

§ 2 Service Description

DeepedIn is a hosting platform for scientific and journalistic content (hereinafter referred to as "Deep Drops"). The platform enables users to upload, publish, and share their own research papers, articles, and related content with the community.

The platform provides, among others, the following features:

  • Storage and publication of PDF documents
  • Interactive execution of Python code in the browser using Pyodide
  • Visualization of scientific data and simulations
  • A merit system for evaluating and recognizing contributions

The Operator reserves the right to modify, expand, or restrict the functionality of the platform at any time. There is no legal claim to the permanent availability of the platform or individual features.

§ 3 User Content and Copyright

Users retain all copyrights and intellectual property rights to the content they upload.

By uploading content, users grant the Operator a royalty-free, temporally and geographically unlimited, non-exclusive license to use the content. This license specifically includes the right to:

  • store and technically process the content (e.g., for PDF rendering, compression, format conversion)
  • make the content publicly accessible on the platform
  • reproduce and distribute the content
  • use the content on other media or platforms operated by the Operator

Users guarantee that they possess all necessary rights to the uploaded content and that publication does not violate any third-party rights (particularly copyrights, trademark rights, or personal rights).

Users undertake to indemnify the Operator against all third-party claims arising from rights violations caused by the user's uploaded content. This includes covering reasonable legal defense costs.

§ 4 Merit System

The platform features a merit system that evaluates user contributions and rewards them with virtual "Merit Points" or reputation scores.

Users acknowledge that these Merit Points and reputation scores are purely virtual in nature and have no monetary value. They cannot be exchanged for currency, sold, or transferred to other users.

There is no legal claim to the allocation, receipt, or retention of Merit Points. The Operator reserves the right to modify, adjust, or discontinue the merit system at any time.

§ 5 Liability

The Operator is only liable for damages caused by intent or gross negligence. There is no liability for slight negligence unless there is a breach of essential contractual obligations (cardinal obligations).

Liability for personal injury (injury to life, body, or health) remains unaffected.

For third-party content (particularly Deep Drops uploaded by users), the Operator is liable in accordance with § 18 of the E-Commerce Act (ECG) only from the moment they become aware of a rights violation. Upon becoming aware of rights violations, corresponding content will be removed immediately (notice-and-takedown procedure).

Code Disclaimer: The execution of Python code via Pyodide occurs in the user's browser at their own risk. The Operator assumes no liability for:

  • Browser crashes or performance issues
  • Data loss on the user's end
  • Security vulnerabilities in client-side code
  • Erroneous or unexpected calculation results

Users are expressly advised not to execute security-critical or production applications via the platform.

§ 6 Code of Conduct

Users undertake to comply with applicable law when using the platform and to refrain from the following actions in particular:

  • Publication of content that violates criminal law provisions (e.g., incitement to hatred, defamation, copyright infringement)
  • Distribution of hate speech, discriminatory, or defamatory content
  • Spam, unsolicited advertising, or commercial mass communication
  • Technical manipulation of the platform or circumvention of security mechanisms
  • Abuse of the merit system (e.g., through fake accounts or coordinated manipulation)

The Operator reserves the right to block user accounts in case of violations of these Terms or without stating reasons (virtual right of domicile). There is no claim to restoration of access.

§ 7 Data Protection

The processing of personal data is carried out exclusively within the framework of applicable data protection regulations, in particular the GDPR (General Data Protection Regulation).

§ 8 Final Provisions

The place of jurisdiction for all disputes arising from or in connection with these Terms is Vienna, Austria, to the extent legally permissible.

Should individual provisions of these Terms be or become invalid or unenforceable, the validity of the remaining provisions shall remain unaffected (severability clause). The invalid provision shall be replaced by a regulation that comes closest to the economic purpose of the invalid provision.

Changes to these Terms will be communicated to users in a timely manner via email or through the platform. If the user does not object to the validity of the new Terms within four weeks of notification, the amended Terms shall be deemed accepted.
